On July 30, 2020, on the recommendation of the Lieutenant Governor of British Columbia, the Minister of Public Safety and Solicitor General signed an Order in Council repealing sections 3, 4, and 10(1)(b) of item 2 in Schedule 2 of the COVID-19 Related Measures Act, SBC 2020, c. 8 (the “Act”). We previously wrote about this Act in our prior article.

Item 2 in Schedule 2 of the Act, is a Ministerial Order (M084/2020) – the Local Authorities and Essential Goods and Supplies (COVID-19) Order, made March 26, 2020.  Specifically, the July 30, 2020 Order in Council repeals:

• section 3, which required each local authority in the Province to immediately implement the local authority’s emergency response plan for the area in which the authority had responsibility;
• section 4, which set aside declarations of local states of emergency which were related to COVID-19 but were declared prior to March 26, 2020; and
• section 10(1)(b), which required the British Columbia Ferry Services Inc. and all other ferry operators in the Province carrying both passengers and vehicles to implement all procedures necessary to ensure priority loading on ferries for residents of sailing destinations.
