BCCA Clarifies Authority of WCAT to Reconsider Its Own Decisions

In December 2014, the BC Court of Appeal issued an important decision in Fraser Health Authority v Workers Compensation Appeal Tribunal.

The Court clarified WCAT’s jurisdiction to reconsider an original WCAT decision, as well as addressed the merits of a claim by certain laboratory technicians that there was a causal connection between their hospital employment duties and their development of breast cancer. This decision will be of great interest to employers responsible for workers’ compensation matters.
